First Ethicon Physiomesh Injury Lawsuit to Go to Bellwether Trial in March

Over 3,000 Product Liability Claims Filed Against Ethicon for Hernia Mesh Injuries

The judge presiding over all Ethicon Physiomesh injury lawsuits released a trial schedule confirming the first “bellwether” case will go before a jury in March 2021. This early trial will address claims that Ethicon’s hernia mesh product caused severe complications and injuries, including the need for revision surgery.

Johnson & Johnson’s Ethicon subsidiary first introduced the Ethicon Physiomesh to the market in 2010. The flexible, multi-lawyered composite mesh product was created to aid in hernia repair surgery and stabilize the area of injury. However, six years later Ethicon recalled the patch after receiving large volumes of complaints that the mesh caused severe complications.

According to the complaints, Ethicon Physiomesh contained design defects that caused the mesh to buckle and fail prematurely, causing severe complications for patients. Injuries associated with hernia mesh failure include recurring hernias, abdominal pain, infection, and the need for revision surgery to fix the failed mesh.

Currently there are over 3,000 Ethicon Physiomesh injury lawsuits filed in the federal court system, each raising similar allegations that the manufacturer sold unreasonably dangerous products to consumers.  Given the common complaints raised in these lawsuits, all Ethicon Physiomesh lawsuits are centralized for pretrial proceedings in the Northern District of Georgia as part of a multidistrict litigation. U.S. District Judge Richard Story presides over the litigation and recently established a “bellwether” trial process to assess how juries will likely respond to evidence and testimony likely to be repeated throughout the thousands of hernia mesh claims.

In a case management order released January 6, Judge Story indicated four cases have been prepared for trial, and the first Ethicon Physiomesh trial to go before a jury starts March 18, 2021. This trial will address claims brought by Jim and Diane Crumbly, who allege an Ethicon Physiomesh patch caused severe complications and injuries.

Experts indicate the trial will last about two to three weeks. Following the conclusion of this first trial, two additional trials are set to begin, the first on June 7 and the second on September 13. Though the outcomes of these bellwether trials do not bind the outcomes of other trials, they will be closely watched by parties in the litigation in hopes of working toward a Ethicon Physiomesh settlement.
